Planning Legislation
Planning legislation in Scotland has recently undergone reform. The Planning etc. (Scotland) Act 2006 sets out these changes.
The Scottish Government Website contains offers the following statement of aims: -
"The Scottish Government aims to deliver a modern planning system that is:
* Efficient: up to date development plans to be at the heart of an efficient system that provides certainty for users and local people
* Inclusive: local people to be more involved in the decisions that shape the development of their communities
* Fit for purpose: with a clear sense of priorities, and to address different issues in different ways
* Sustainable: development to contribute to economic growth that is sustainable. Planning will deliver sustainable development ensuring development is in the right place, and of the right quality."
The primary Scottish Government publications that are relevant to the contents and purpose of this website are related to development planning (which is the process of creating Local Development Plans to identify policies to steer development in the appropriate manner, and allocations of land to steer development to the right places) and development management (the use of the Local Development Plans and other statutory instruments to determine specific planning applications) are Circular 1/2009 - Development Planning, and Circular 4/2009 - Development Management Procedures. Whether a planning application is classed as national, major or local is identified in Circular 5/2009 - Hierarchy of Developments.
